Question about Ebay, Buyer’s Responbilities?

Is it the buyer’s responsibility to read an auction in its entirety. So, for example if the title says Brand new car, the bidding starts at 1000.00 USD, and in the auction it says you could get either a Brand New Car or a bicycle, and I bid on it, if I get a bicycle, I have no case ?

While your example is (purposely, I assume) on the outrageous side, it IS the responsibility of the buyer to read the entire listing.

If an item states in the text of the listing that there are ‘issues’ regarding condition, for example, and the buyer attempts to later get a refund due to those issues because the item was ‘significantly different than as posted’, they would lose. That is why it is always important for the SELLER to point out anything in the item that might cause problems – and for the BUYER to read everything, including the FINE PRINT – make that ESPECIALLY the fine print.

Listings that are deliberately misleading (or SEEM to be) should be reported to be reviewed by ebay staff.

I’m backing out of a Bad Ebay Deal…can you help?

I won an auction for a car on ebay: 1981 Checker Marathon. My winning bid was $1,000. Instead of having it delivered, I wanted to pick it up in person. The round trip took me 15 hours with 822 miles! I paid my mechanic to come with me so he could put new plugs and wires on the car and make sure it would be safe for travel as the owner said it would be. Before bidding, during bidding, and after bidding, I kept in contact with the seller, asking as many questions about the car as I could think of. Upon arrival at this dealers location, My mechanic and I are furious to find that the car has no floor!! Thats correct, under the loose carpet are several holes big enough for me to put my legs through. This is a car only Fred Flinstone could love. I knew it needed some cosmetic work and carburater work, but the seller failed to mention this and is now threating me with court, lawyers, ebays buyer policy, so on & so on. I had not paid her yet and I do not intend on paying her. Your thoughts?

She obviously was holding information from you about the car which is obviously something pretty serious. I would get in contact with e-bay and let them know what’s happening and if worse comes to worse, go to court because she‘ll end up losing. She with held very important information about the car which should have been presented to you before you drive 15 hours out of your way. She broke e-bay rules but like I said to cover your butt contact e-bay personally and tell them what’s going on. I think she’s going to be the one held at fault.
