How to take legal action against eBay merchants?

I was wondering if somebody could help me out here. I bought a hard drive through eBay almost two months ago. I saw a good deal and clicked buy it now before somebody else was going to snatch it up. Because I didn’t read the auction thouroghly enough, and didn’t realise that paypal wasn’t accepted. I felt oblidged to go through with the deal and pay with a money order to the tune of 389USD.

To keep a very long story short – He took my money, didn’t send me the hard drive and has told me over a phone conversation that he’s stolen my money and I won’t get it back.

I’ve allready filled an eBay dispute, I’m just wondering what kind of legal action I could take? I suspect it would cost more money to hire an attourney for this case than it’s worth…

    If you’re lucky then you’re in the same state or relatively near by… because you could go to small claims court. Better yet, you could contact one of the small claims television court shows and then you are guaranteed to recoup your money if you appear on their show.

    do you have any real information on him that you may be able to pursue? Like address, email, phone number?
    Have you tried contacting police? Kick EBay in the butt also, how did this guy get on to sell?

    legal action is going to cost you more that the $400 you spent on the hard drive and it’s not that he hasnt broken the law but you’ll have a hard time getting any law enforcement agencies interested in charging him. chalk it up to experience, always read the small print.

    you could try reporting it to ebay but that wont get you your money back,

    finally i’d sugest getting some large friends and going to his house and asking politely for your money back.

    you can also file a police file e-bay will not do much about it other than lock his e-bay account

    Ebay may help you, but don’t count on it. The cost of a lawyer would far exceed the return if you went to court, but you can take the merchant and ebay to small claims court and ebay probley woyuld settle before sending a lawyer to court.
    The small claims court cost to yuo is only about 25 top 50 bucks which you woyuld get back if you won.

    I HEARD THAT IN INTERNET ARE LIKE COPS TO YOU CAN REPORT HIM AND THEY WILL DO SOMETHING TO HIM, BUT I DON’T REMEMBER THE PAGE WHERE I SEE THIS YOU CAN SEARCH. AND LET A BAD FEEDBACK TO THE SELLER, AND EMAIL ME AND LET ME KNOW WHO IS THE SELLER SO I WON’T BUY FROM HIM

    Ebay is normally pretty good about resolving disputes. Give them time to look into it.
    First thing I would do is leave a negative feedback warning other customers.
    Do you have proof you mailed a money order, do you have a receipt of some kind? That would definitly help.
    Personally I never buy or bid on anything where they don’t take paypal, no matter how good the price is and always check out the feedback of the seller. I’ve only had one problem and got my money back thanks to ebay and paypal.
    A lawyer will probably end up costing more then what you paid, but it wouldn’t hurt to look around. I’m sure there are some that offer free consultations.

    get somekind of legal lawyer to talk to , dont buy him, just ask him what he would do if it happened to him. and dont tell him it actually happened, cause he will leave out important info on u, so u purchase his assistance

    File a small claims action against him, in pro per.

    Hiring a lawyer will cost you many times the value of the non-delivered item.

    Don’t EVER pay eBay sellers with something other than a credit card and/or PayPal.

    I was ripped off by a seller on ebay also but I went through paypal and got my (most of) money back. What ebay does is gives you all the sellers personal info. Their phone number, address, city and state. Get that from ebay if you haven’t already and get the law/attorney involved. More than likely the seller will end up paying your fees.

    First – if you ever have to pay via money order again – always use a USPS (Postal Service) Money Order – it adds to the ‘teeth’ if the individual is prosecuted.

    Second – give eBay a chance, they tend to protect the buyer, not the seller.

    Third – you can remotely file a complaint with the local (county level) sheriff’s department (in the seller’s area). Contact them and make them aware, and request the either fax or mail a complaint form. Be sure to have proof of the money order being cashed and where – and include this information. If by chance it was deposited to a specific bank account – notify the bank as well.

    Lastly, you can file with your local postal investigator – best to go to the local sort center and file in person.

    The more you pursue the more likely you are to find resolution.
